Terms of Use

Okay, I guess we need to chat a little bit about just what you can and can not do with my work.

Some works on this site are licensed for use under a Creative Commons Attribution-Noncommercial-Share Alike 2.5 License. The Creative Commons license is clearly indicated on the page. Creative Commons licensing applies only to the work on that page and not the code, layout, graphics of the flipside B website itself. Creative Commons licensing only applies to works on this site that are clearly marked with the Creative Commons license.

Otherwise, keep the following in mind:

The first thing that we need to be clear about is that everything on this site is my work. My work referring to original materials created by Barbara L.M. Handley.

Everything on this site is protected by U.S. and international copyright law. Everything.

The words, the poetry, the stories, the plays, the photos, the images, the site design, the html code, the css code, etc., etc.

Even if I didn't list it specifically, it still belongs to me.

The doctrine of Fair Use means that you can do some things with my work without my express permission. You can print out a copy of one of my poems. You can view the site. If you compete in forensics and want to use one of my poems, or a portion of a play or a story, in an interpretive speech, go for it.

Fair Use doesn't apply to the whole thing, though. You can't perform my play in its entirety without my permission.

One thing you surely may not do is republish my stuff anywhere else for any reason. Not on your website, not on your blog, not in a magazine or in an anthology. (Unless I've licensed it under Creative Commons and then you still can't use it for commercial purposes (including, but not limited to, use as content on a web page that generates ad revenue) and you must include the attribution statement provided on the page and if you create a derivative work, you have to license whatever you do under the identical Creative Commons license.)

Not without my explicit written permission.

You'll know if you have permission because you'll be holding an actual piece of paper that you received via fax or snail mail that has my real life signature on it and a statement detailing exactly which rights I'm releasing to you.

It's unlikely, but possible, that I will grant such permissions for free. This is, after all, my livelihood, and I have kids to feed.

You also may not hotlink any of my images. It's risky anyway, I might replace it with something you'd rather not see on your site.

Basically, be nice, be fair. Don't steal my work, don't steal my bandwidth. Ask first.

But don't steal my work. I'll fall on you like the wrath of God.

Nothing I've said here should be construed in any way to suggest that I have waived or rescinded any legal rights I have under applicable U.S. or international copyright laws.

You may not reproduce, republish or distribute content from Flipside B in any form without express written permission from Barbara Handley unless that specific work is licensed under a Creative Commons license. All rights reserved.
